Agreement to Terms

By accessing or using Alive Together ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Eligibility

Age Requirement

• You must be at least 13 years old to use Alive Together
• If you are under 18, you represent that you have your parent's or guardian's permission to use the App

Account Requirements

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

User Accounts

Account Creation

You may create an account using:

• Email and password
• Google Sign-In
• Apple Sign-In

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You agree not to share your account with others
• You agree to notify us immediately of any security breach or unauthorized access

Account Termination

• You may delete your account at any time through the App settings or by contacting us
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App will immediately cease

Zero Tolerance Policy

Alive Together has NO TOLERANCE for objectionable content or abusive users. We strictly prohibit:

Objectionable Content

The following types of content are strictly prohibited and will result in immediate account suspension or permanent ban:

• Hate speech, discrimination, or harassment
• Explicit sexual content or nudity
• Violence, threats, or graphic content
• Illegal activities or content

Abusive Behavior

The following behaviors are strictly prohibited and will result in immediate account suspension or permanent ban:

• Harassment, bullying, or intimidation
• Impersonation or identity theft

Violations of this policy will result in immediate account suspension or permanent ban without warning.

Acceptable Use

You Agree To:

• Use the App only for lawful purposes
• Respect other users and their content
• Provide accurate information
• Maintain appropriate behavior in all interactions
• Respect intellectual property rights
• Report any objectionable content or abusive behavior

You Agree NOT To:

• Harass, abuse, or harm other users
• Post inappropriate content, including:
  • Nudity, pornography, or sexually explicit content
  • Violence, threats, or hate speech
  • Content that promotes illegal activities
• Impersonate others or provide false information
• Interfere with the App's operation or security
• Attempt to gain unauthorized access to other accounts or systems
• Use automated systems (bots, scrapers) to access the App
• Violate any laws or regulations
• Collect user data without permission
• Reverse engineer or attempt to extract source code

Content and Submissions

Your Content

• You retain ownership of content you create (photos, text, etc.)
• By submitting content, you grant us a license to:
  • Store, display, and distribute your content through the App
  • Make your content available to other users as intended by the App's features
  • Use your content to operate and improve the App

Content Standards

• All submissions must be your original work or you must have permission to use them
• Submissions must comply with these Terms and applicable laws
• We reserve the right to remove any content that violates these Terms

Moment Submissions

• Daily moments are provided for entertainment and creative purposes
• You may submit one photo or video per moment per day
• Submissions are subject to review and may be removed if they violate these Terms
• Submissions may be visible to:
  • All users (in Global feed)
  • Your friends (in Friends feed)
  • Group members (in Group feeds)
  • Users viewing your profile

Chat and Messaging

Chat Features

• The App provides one-on-one and group chat functionality
• Chat supports text messages, photos, videos, voice messages, documents, GIFs, stickers, polls, and location sharing
• You may use the message translation feature, which sends message text to a third-party translation service (DeepL)

Disappearing Messages

• You may enable disappearing messages in conversations, which are automatically deleted after the configured duration
• Recipients may still capture or save content before it disappears; we are not responsible for content saved by other users

LiveSnaps

• LiveSnaps are ephemeral photos and videos shared with friends that expire after 24 hours
• LiveSnaps are automatically deleted from our servers after expiration

Groups

• You may create, join, and participate in groups
• Group creators and administrators may set group rules and manage membership
• Content shared in groups (submissions, chat messages) is visible to all group members
• We reserve the right to remove groups that violate these Terms

Voice and Video Calls

• The App provides voice and video calling features powered by third-party infrastructure (Agora)
• Call audio and video are routed through Agora's servers in real time and are not stored
• You are responsible for ensuring your use of calling features complies with applicable laws

Friend Requests and Social Features

Friend Requests

• You may send friend requests to other users
• Users may accept or decline friend requests
• You may unfriend users at any time
• We are not responsible for disputes between users

Contact-Based Friend Discovery

• With your permission, the App can access your device contacts to help you find friends on the platform
• Phone numbers are cryptographically hashed before transmission; we never store or see your contacts' actual phone numbers
• You may revoke contact access at any time through your device settings

Privacy Settings

• You can set your profile to "Private" (only friends see your posts)
• Public profiles are visible to all authenticated users
• Friend lists and connections are visible to your friends

Intellectual Property

Our Rights

• The App, including its design, features, and content, is owned by us or our licensors
• Our trademarks, logos, and brand names are our property
• You may not use our intellectual property without permission

Your Rights

• You retain ownership of content you create
• You grant us a license to use your content as described in these Terms

Prohibited Activities

The following activities are strictly prohibited:

1. Illegal Activities: Any use of the App for illegal purposes
2. Harmful Content: Posting content that could harm others
3. Spam: Sending unsolicited messages or friend requests
4. Fraud: Attempting to deceive or defraud others
5. Hacking: Attempting to breach security or access unauthorized areas
6. Commercial Use: Using the App for commercial purposes without permission
7. Data Mining: Collecting user data without authorization

Termination

By You

• You may stop using the App at any time
• You may delete your account through the App settings

By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Harm other users or the App
• Fail to pay any required fees (if applicable in the future)

Effect of Termination

• Your right to use the App will immediately cease
• We may delete your account and associated data
• Some information may be retained as required by law

Disclaimers

Service Availability

We strive to provide reliable service but cannot guarantee:

• Uninterrupted or error-free operation
• That the App will meet your specific requirements
• That the App will be available at all times

Content Accuracy

• We do not guarantee the accuracy, completeness, or usefulness of any content
• User-generated content reflects the views of the creator, not ours
• We are not responsible for content posted by users

Third-Party Services

• The App uses third-party services (Firebase, Google, Apple, DeepL, GIPHY, Agora, Carto)
• We are not responsible for the availability or performance of third-party services
• Your use of third-party services is subject to their terms and policies

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid to use the App (if any)
• We are not responsible for:
  • Loss of data or content
  • Loss of profits or business opportunities
  • Personal injury or property damage
  • Actions of other users

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Content you submit

Dispute Resolution

Informal Resolution

We encourage you to contact us first to resolve any disputes. Contact us at: support@missionsnap.com

Binding Arbitration (if applicable)

Any disputes that cannot be resolved informally may be subject to binding arbitration. Arbitration will be conducted in accordance with Swiss law.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending you an email notification (for material changes)

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. The exclusive place of jurisdiction is Zürich, Switzerland.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Additional Terms for Specific Features

Offline Functionality

• Content stored locally for offline use is subject to these Terms
• Queued submissions will be uploaded when connection is restored
• We are not responsible for data loss due to device issues

Daily Moments

• Moments are provided for entertainment purposes
• We reserve the right to modify, remove, or add moments at any time
• Moment availability may vary by timezone

Photo and Video Submissions

• Photos and videos must be appropriate and comply with content standards
• We reserve the right to remove submissions that violate these Terms
• Submissions may be stored on our servers and visible to other users

Location Sharing

• You may optionally share your location in chat messages
• Shared locations are visible to other participants in the conversation
• Location sharing is always opt-in on a per-message basis
